Order acceptance

You agree that your use of the Photoscene website or any part of it is subject to the following terms. You are deemed to have agreed to and accepted the following terms if you continue to browse and use the Photoscene website or any part of it.

Delivery time

Under no circumstances may any delays in delivery times justify cancellation of the order or any right to compensation. Estimated delivery time is within 14-28 days.

Returns and cancellations

When placing orders for goods and services on the Internet you would generally have the right to cancel your order, free of charge, by giving notice within 14 days of the order. However, this does not apply where the service ordered is commenced immediately. You hereby consent to the Photoscene online services commencing immediately and as such you will not have a right to cancel your orders. We will, naturally, do our best to stop producing an order if you contact us quickly. Due to the personalised nature of the photographs we are unable to offer refunds on these items, save where we are required to do so by law. Products deemed to be faulty should be returned within 2 weeks of receipt. As soon as we receive the item and it has been checked we will either refund your card or send a replacement. Refunds may be given at the discretion of the management; should you have any questions please call or email us.

Age

You warrant and undertake that you are at least 18 years of age and the authorised owner of the credit/debit card details which you use to make purchases through our online card processor.

Payment card information

Photoscene does not hold any information regarding card number, expiry date or card security code. All credit and debit card purchases are processed on secure third party servers

Data Protection &Privacy Policy

1. Definitions and Interpretation

In this Policy the following terms shall have the following meanings:

"Account" means an account required to access and/or use certain areas and features of our site;
"Cookie" means a small text file placed on your computer or device by our site when you visit certain parts of our site and/or when you use certain features of our site. Details of the Cookies used by our site are set out in Part 14, below;

This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in many cases.
i) Rights relating to automated decision-making and profiling. [we do not use your personal data in this way.]

It is important that your personal data is kept accurate and up-to-date. If any of the personal data we hold about you changes, please keep us informed as long as we have that data. If you have any cause for complaint about our use of your personal data, you have the right to lodge a complaint with the Information Commissioner''s Office. We would welcome the opportunity to resolve your concerns ourselves, however, so please contact us first, using the details in Part 14.

6. How Do You Use My Personal Data?

Under the Data Protection Legislation, we must always have a lawful basis for using personal data. The following table describes how we may use your personal data, and our lawful basis for doing so:

6. How Long Will You Keep My Personal Data?

We will not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected. Your personal data will therefore be kept for the following periods (or, where there is no fixed period, the following factors will be used to determine how long it is kept):

A Summary of the length of time we retain different types of information is as follows:

Photographs: These are the intellectual property of Photoscene, and Copyright on such work lasts for 75 years. We will, therefore, retain Photographs for 75 years. After this point images are reviewed for longer preservation, to assess their Historical Relevance. If they are likely to become valuable Historically, they are added to the Archive.

Order Data: This is kept for 20 years in order to be able to inform you whether or not you have previously ordered a particular photograph(s).

8. How and Where Do You Store or Transfer My Personal Data?

We store or transfer some or all of your personal data in countries that are not part of the [European Economic Area (the "EEA" consists of all EU member states, plus Norway, Iceland, and Liechtenstein)] OR [EEA]. These are known as "third countries" and may not have data protection laws that are as strong as those in the UK and/or the EEA. This means that we will take additional steps in order to ensure that your personal data is treated just as safely and securely as it would be within the UK and under the Data Protection Legislation as follows:

9. Do You Share My Personal Data?

We will not share any of your personal data with any third parties for any purposes, subject to the following exception.

If any of your personal data is shared with a third party, as described above, we will take steps to ensure that your personal data is handled safely, securely, and in accordance with your rights, our obligations, and the third party''s obligations under the law, as described above in Part 8.

If any personal data is transferred outside of the EEA, we will take suitable steps in order to ensure that your personal data is treated just as safely and securely as it would be within the UK and under the Data Protection Legislation, as explained above in Part 9.

In some limited circumstances, we may be legally required to share certain personal data, which might include yours, if we are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority.

10. How Can I Control My Personal Data?

10.1 In addition to your rights under the Data Protection Legislation, set out in Part 5, when you submit personal data via our site , you may be given options to restrict our use of your personal data. In particular, we aim to give you strong controls on our use of your data for direct marketing purposes (including the ability to opt-out of receiving emails from us which you may do so at the point of providing your details.

10.2 You may also wish to sign up to one or more of the preference services operating in the UK: The Telephone Preference Service ("the TPS"), the Corporate Telephone Preference Service ("the CTPS"), and the Mailing Preference Service ("the MPS"). You may access certain areas of our site without providing any personal data at all. However, to use all features and functions available on our site you may be required to submit or allow for the collection of certain data.

12. How Can I Access My Personal Data?

If you want to know what personal data we have about you, you can ask us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a "subject access request".

All subject access requests should be made in writing and sent to the email or postal addresses shown in Part 14. There is not normally any charge for a subject access request. If your request is ''manifestly unfounded or excessive'' (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding.

We will respond to your subject access request in not more than one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.

Our site does not use cookies.

The content of the Photoscene website is only for your general information and use only. It is subject to change without notice.

Neither we nor any such third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Photoscene website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Photoscene are unable to accept liability for any incorrect information supplied to us by you the customer.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. It is protected by intellectual property laws including, but not limited to, copyright.

Unauthorised use of this website may give to a claim for damages and/or be a criminal offence.

We do not guarantee that use of this website will be compatible with all hardware and software which may be used by visitors to the site.

Law

This Agreement shall be subject to and constructed according to English Law and the parties agree to accept the exclusive direction of the Courts of England.

Copyright and Ownership

In accordance with the Copyright, Designs & Patents Act 1988, the copyright of all images created Photoscene is owned by Photoscene. Unless Photoscene gives written authorisation, site users are forbidden by law to copy any images created by Photoscene and agree that all photographic reprints, digital duplications or copies of any type made from images created by Photoscene shall only be carried out by Photoscene.

Prices & Terms

Photoscene reserve the right to amend both Prices and these Terms and Conditions without prior notice.

Product specifications

The colours of mounts and frames may vary slightly from any shown due to differences in monitor calibrations.

Our mounts and frames may be subject to change from time to time.

Any photograph will fade over time, particularly if it is exposed to direct sunlight. Photoscene cannot accept responsibility for this gradual image fading.
